Terms and Conditions of Sale

1. Purpose

These Terms and Conditions of Sale (hereinafter "T&Cs") govern all relations between HAUTANE SAS (hereinafter "HAUTANE") and any person wishing to sell a luxury item via the hautane.com platform (hereinafter "the Seller").

2. Submitting an item

The Seller may submit an item for sale by completing the online form. Submission is free and without commitment. HAUTANE reserves the right to refuse any item that does not meet its quality and authenticity criteria.

3. Valuation and offer

After submission, HAUTANE undertakes to provide a valuation within 24 to 48 business hours. This valuation is indicative. The firm offer is communicated after review of the photos and information provided. The Seller is free to accept or decline the offer.

4. Types of offers

4.1 Immediate purchase

HAUTANE purchases the item at the agreed price. Payment is made by bank transfer within 48 hours of receipt and authentication of the item. The transfer of ownership is effective upon validation by HAUTANE.

4.2 Consignment sale

The Seller entrusts their item to HAUTANE for listing on the platform. The item remains the property of the Seller until it is sold. The Seller receives the agreed percentage of the final sale price. The Seller may retrieve their item at any time as long as it has not been sold.

5. Shipping

Items are shipped exclusively by post via HAUTANE's partner carriers. A prepaid shipping label is provided free of charge to the Seller.

Each parcel is insured for 100% of the estimated value of the item. The Seller undertakes to carefully package the item and drop it off at a collection point within 7 calendar days of accepting the offer.

In the event of loss or damage during transit, HAUTANE will provide full compensation to the Seller based on the estimated value.

6. Authentication

Every item received undergoes a physical inspection by HAUTANE's specialists. If the item is found to be non-authentic, it is returned to the Seller at their expense and the transaction is cancelled.

7. Payment

Payments are made by bank transfer to the account provided by the Seller. For immediate purchases, the transfer is issued within 48 hours of authentication. For consignment sales, the transfer is issued within 48 hours of the actual sale of the item.

8. Seller's warranties

The Seller warrants that:

• They are the legitimate owner of the item
• The item is authentic and matches the description provided
• The item does not originate from theft or handling of stolen goods
• The item is not encumbered by any third-party rights

9. Liability

HAUTANE undertakes to handle each item with the utmost care. HAUTANE's liability is limited to the estimated value of the item. HAUTANE shall not be held liable for indirect damages.

10. Data protection

Personal data collected is processed in accordance with the GDPR. It is used solely within the scope of the commercial relationship and is not shared with third parties. The Seller has the right to access, rectify and delete their data.

11. Applicable law

These T&Cs are governed by French law. Any dispute shall be submitted to the competent courts of Paris.
